Attorney in Smollett case subpoenaed to appear before special prosecutor

Chicago prosecutor Kim Foxx is being subpoenaed for her handling of the Jussie Smollett case.

According to reports Friday, retired appellate Judge Sheila O’Brian filed a petition for Foxx and her top deputy to appear before a special prosecutor along with “Empire” actor Jussie Smollett.

This comes after Foxx’s office dropped all charges against Smollett in March after he was on trial for allegedly staging a hate crime.

The subpoena requests Foxx and Smollett produce all original documents for the case to prove they had not been altered or destroyed.

Foxx has defended her decision to drop charges against the Hollywood star, and has said she welcomes an independent investigation.
